1.1. These Terms of Use ("Terms") govern the access to and use of the services offered by JAMBLE BRASIL DIVULGAÇÃO DE PRODUTOS LTDA., a private legal entity, registered with the Brazilian Corporate Taxpayer Registry (CNPJ) under No. 63.859.095/0001-13, with its registered office at Rua Maria Paula, No. 122, Conj. 1011, Sala 2, Bela Vista, São Paulo/SP, CEP 01319-907 ("Jamble"), through the mobile application available on the App Store and Google Play, and through the website jamble.com (jointly, the "Service").
1.2. Jamble operates a social-media-inspired live-shopping marketplace that uses video and live streaming to connect buyers and sellers of fashion, collectibles, lifestyle and similar products. Jamble acts exclusively as a technological intermediary, providing a platform on which third parties (Sellers) may offer their own products to Buyers.
1.3. Jamble is not a party to the sale transactions entered into between Buyers and Sellers, and does not act as seller, importer, manufacturer, distributor or merchant of the products listed, without prejudice to the obligations that Brazilian legislation imposes upon marketplaces, notably the Brazilian Consumer Protection Code (Código de Defesa do Consumidor).
1.4. By accessing or using the Service, the User declares to have read, understood and fully accepted these Terms, as well as the Privacy Policy available at jamble.com/privacy.
2.1. By accessing or using the Service, the User expresses full and unequivocal acceptance of these Terms of Use, the Privacy Policy and any other documents referenced therein (jointly, the "Contractual Documents"), thereby forming a binding contractual relationship between the User and Jamble.
2.2. A User who does not agree, in whole or in part, with the Contractual Documents must refrain from using the Service and, if the User already holds an account, must proceed to close it in accordance with Section 27.
2.3. Should the User have questions regarding the interpretation of any provision of the Contractual Documents, the User may contact Jamble through the channels indicated in Section 30.
3.1. Use of the Service is exclusively permitted to natural persons aged 18 (eighteen) or older, with full legal capacity under Brazilian law, and to duly incorporated legal entities. Upon creating an account, the User expressly declares to meet the minimum age requirement and to have full civil capacity, or to hold representative capacity on behalf of the relevant legal entity.
3.2. Jamble may, at any time and at its sole discretion, request documents evidencing identity, age, civil capacity, address, CPF or CNPJ registration, or any other information necessary to verify the registration. Unjustified refusal or the submission of false, incomplete or outdated documents authorizes the immediate suspension of the account and, where applicable, its cancellation.
3.3. To create an account, the User must provide a valid phone number (for Google Play registrations) or a valid email address and phone number (for App Store registrations). Jamble may additionally associate the account with third-party authentication providers (Apple, Google, Facebook, TikTok), as described in the Privacy Policy.
3.4. Each User may hold only one active account on the platform. The creation of multiple accounts, the sharing of credentials with third parties or the use of the account by any person other than the account holder are expressly prohibited, except in the case of a User that is a legal entity which formally authorizes collaborators to operate the account on its behalf.
3.5. The User undertakes to provide and keep updated truthful, complete and accurate information, and shall be fully liable, civilly and criminally, for the veracity of the registration data.
3.6. The User is solely responsible for the safekeeping and confidentiality of the access credentials, and shall be fully liable for any activity performed through the account. The User must immediately notify Jamble of any suspected unauthorized use.
4.1. The processing of personal data by Jamble in connection with the Service is governed by the Privacy Policy, available at jamble.com/privacy and an integral part of these Terms, drafted in strict compliance with the Brazilian General Data Protection Law (Law No. 13.709/2018 - "LGPD").
